Terms And Conditions

THESE TERMS AND CONDITIONS FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU AND US, CARPET CALL (HOLDINGS) PTY LTD (ABN 78 010 037 144) (CARPET CALL), FOR THE SUPPLY AND PURCHASE OF PRODUCTS FROM THE SITE. BY USING THE SITE OR PURCHASING PRODUCTS THROUGH THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD, AND AGREE TO BE BOUND BY, THESE SUPPLY TERMS AND CONDITIONS.

Amendments to terms and conditions

We reserve the right to amend these terms and conditions at any time.  Any amendments shall be effective immediately upon notification on the Site.  Your continued use of the Site following such notification or purchase of products thereafter will represent agreement by you to be bound by the terms and conditions as amended.

Online Shopping for Textiles

Please note that when shopping online items on the Site, and in particular textiles, may appear differently on screen that it appears in real life.  This may be caused by your screen settings or the settings that were used in the production of the original image.  Colours and texture are often difficult to see and judge online with 100% accuracy.  Our manufacturers make every effort to match dye lots, however, customers are also warned that colour shades and variations may appear in the product (including, but not limited to, when the product is exposed to UV light). The characteristics of all cut pile rugs and carpet render them subject to shading which can often take the appearance of water marks.

Please be aware of this and take it into account when you are reviewing your order.

Orders

To place an online order you must be over 18 years old.

By placing an order for products through the Site you are making an offer to purchase those products for the price listed at the time you place the order (including all applicable delivery costs and taxes).  If you change your mind after placing an order and wish to cancel the order you should contact us immediately and we will endeavour to cancel delivery, however, if the product has already been dispatched then you acknowledge and accept that the product will be delivered in accordance with these terms and conditions and the Returns Policy will apply to your change of mind.

Carpet Call reserves the right to accept or reject any order in whole or in part for any reason, including, without limitation, in respect to the unavailability of any products or an error or omission with respect to the product (including, but not limited to, any image or information relating to the product). We will endeavour to notify you within a reasonable time or any such rejection. Carpet Call shall not be liable for any loss or damage caused by rejection of the order, any delay to accept or reject the order or to deliver the product.

You must provide and complete all information required at the checkout and provide us with any additional details if requested by us in connection with your order.  You must provide us with complete and accurate details when making an order through the Site.

Delivery Costs

Freight and delivery charges will be notified to you at checkout, if applicable.  These charges may depend on your location, size, weight and quantity of product(s) ordered.  Orders for multiple products may be split across multiple deliveries depending on where it was shipped from.

Payment

We accept payment by Visa, MasterCard and PayPal. If you choose to pay by credit card, you authorise us to debit the amount that is payable for an accepted order from your nominated credit card.  You must not pay, or attempt to pay, for products through any fraudulent or unlawful means.

If we are unable to successfully process payment for your order, we may reject or cancel your order.

All payments are made by a secure server, which will encrypt each transaction as a security precaution. However, you acknowledge that despite reasonable precautions on our part, there is a risk of unauthorised access to, or alteration of, your transmissions of data or of information contained on your computer system or on the Site and therefore you should be aware that you supply this information at your own risk.  To the maximum extent permitted by law, we accept no liability for any loss or damage of any kind including, without limitation, liability to a third party which you may suffer or incur as a result of such activity.

Delivery at Nominated Address

You may select at the checkout to collect your order from one of our participating stores or have your order delivered to a street address in Australia.  We cannot ship to PO Boxes or addresses outside of Australia.

We currently do not offer delivery for Hard Flooring Products.

Only VIC, QLD, NSW, SA and WA capital city metropolitan stores currently offer the collection option.  You will be notified when the Product is ready to be picked up from your nominated store.

All deliveries to a street address will require a signature at the point of delivery, unless you grant, at the checkout, “Authority to Leave” without signature.  If you grant “Authority to Leave”, you acknowledge that neither Carpet Call nor its couriers bear any responsibility or liability to you for any consignments that are lost or stolen after our carriers have recorded the parcel as “successfully delivered”.

If no one accepts delivery at your nominated address (with the exception of our stores), Carpet Call or its carriers will endeavour to contact you to arrange for delivery at a different time. We may charge you an additional delivery fee for re-delivery of your order.  You acknowledge and agree that any person at the delivery address who receives and signs for the delivery is authorised by you.

It is your responsibility to ensure that you provide Carpet Call with a delivery address where someone will be present to sign for the consignment during business hours (7am – 5pm, Monday to Friday).  On many occasions carriers may deliver orders over two different deliveries dependent on the size of the order. Please note that ground and air shipments can be assigned to separate trucks and may arrive at different times of the day.

International

Sorry, Carpet Call only ships within Australia.

How To Track Your Order

You will receive an email notification, to your nominated email address, confirming your order together with a unique consignment number.  If you do not receive an email confirming the order and the unique consignment number within 3 business days then please call us on 07 3489 1333 so we can resend the  email notification to you.

We use a combination of carriers to ensure flexibility with delivery options. These services will generally have an online tracking and trace system. If your order is taking longer than expected, or, you want to find out when it will arrive, you can check its progress by clicking on the tracking link that was sent to you in the confirmation email.  This link will take you directly to the carrier’s website where you can keep an eye on your delivery.  We make no representation or warranty in respect of the carrier’s website or tracking service or whether the website or service will be available, accurate or suitable for your intended use. You can also contact the carrier with any questions or concerns about your delivery.

If your order is significantly delayed please contact our Customer Service Team on (07) 3489 1333 between 9am and 5pm (CST), Monday to Friday. You can also get in touch with our Customer Service Team via email. You will need to quote your order number in any communication with Carpet Call.

Delivery Times

As a general rule we aim for a 2 business day turnaround from our receipt of your order to shipment of in-stock products from our warehouse. There are circumstances out of our control that will delay shipping.   As a general rule, deliveries can take between 2 and 10 working days to arrive at your nominated address. We accept your order on the basis that we cannot be responsible for delays including, but not limited to, delays out of our control.  If there are any unexpected delays, we will advise you as soon as we are aware and keep you updated with the status of your order.

Missing, Damaged or Defective Products

It is your responsibility to ensure that the product you have ordered is correct, and, in a reasonable condition prior to signing for delivery.

If the product or any packaging appears damaged on delivery, you should refuse to accept the delivery and contact (07) 3489 1333. If you have already accepted a product and later discover that it has been damaged or is missing parts or is otherwise defective, our Returns Policy set out on the Site will apply.

All products ordered on the Site are subject to our Returns Policy on the Site.

No representation

We do not warrant or represent the accuracy, completeness or suitability for your intended use of the product or any information on the Site in respect of the product.

All information on the Site is of a general nature only and is not intended to constitute professional advice.  The Site may contain information that includes the views or recommendations of others that are not necessarily our views.

You should make your own enquiries to check if the information on the Site is accurate, complete and suitable for your intended use.

Statutory warranties

To the fullest extent permitted by law, our liability under any guarantee, condition or warranty (including, without limitation, any guarantee, condition or warranty of merchantability, acceptable quality, fitness for purpose or fitness for disclosed result), or any other right or remedy, under any legislation or implied into these terms and conditions by any legislation (Statutory Warranties) is hereby excluded.  Where we are liable under any Statutory Warranties, and any legislation avoids or prohibits provisions in a contract excluding or modifying the application of, or exercise of, or liability under, such Statutory Warranties, our liability for any breach of such Statutory Warranties shall be limited, at our option, to one or more of the following: (a) if the breach relates to goods: the replacement of the goods or the supply of equivalent goods; the repair of such goods; the cost of replacing the goods or of acquiring equivalent goods; or the cost of having the goods repaired; and (b) if the breach relates to services: the supplying of the services again or the cost of having the services supplied again. You acknowledge and agree that reliance by us on this limitation of liability is fair and reasonable in all the circumstances.

Privacy

When you order products, we collect information about you including, but not limited to your name, credit card details and other contact details.

You consent to Carpet Call using the information we collect about you to process sales on the Site and to assist us and other entities in offering services and products to you (including news and general promotional material which may be useful to you).  If you do not wish to have your personal information used in this manner or for any other specific purpose, you can contact us through the Site. However, please be aware that you may not be able to access, or use, all or part of this Site (including ordering products) as a consequence.

We may provide your personal information to our related companies, our stores, couriers and other third parties for the performance services to you. We may also share your data with third parties such as financial bodies, credit card companies in order to process transactions.

Please be advised that you are entitled to have access to the personal information you have previously supplied to us.

We will not be liable for any disclosure of your personal information to any third party authorised under these terms and conditions or otherwise permitted by law.

Use of cookies

We may utilise “cookies” which enable us to monitor traffic patterns and to serve you more efficiently. Cookies allow you to log into the Site faster and assist you to navigate through the Site with more ease. A cookie does not identify you personally but it does identify your computer. You can set your browser to notify you when you receive a cookie and this will provide you with an opportunity to either accept or reject it in each instance.

General

You may find links to third party websites on the Site. In accessing third party websites you should have regard to the third party website’s privacy policies as we do not accept responsibility or liability for the administration of third party websites.

If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

You agree that the laws of the State of Victoria, Australia will apply to all transactions and communications on this site, and you submit to the jurisdiction of the courts of Victoria to hear any dispute.

These terms constitute the entire agreement between you and Carpet Call regarding the sale of products through the Site.

Notices to us can be sent to Carpet Call Rugs Online, PO Box 6246, Logan Central 4114.  You acknowledge that we may use your primary email to us as your address for any alterations to this policy and you agree to such communications.

Nothing in these terms and conditions creates a relationship of employment, trust, agency, partnership or joint venturer between you and us.

In these terms and conditions, unless the context otherwise requires:

(1) Site means www.carpetcall.com.au;

(3) Carpet Call, us or we means Carpet Call (Holdings) Pty Ltd (ABN 78 010 037 144) and its related body corporate (as defined in the Corporations Act 2001 (Cth))

(4) Words importing the singular include the plural and vice versa;

(5) A reference to a natural person includes any company, partnership, joint venture, association, corporation or other body corporate and any governmental agency; and

(6) A reference to a person includes that person’s successors and legal personal representatives.
